These Terms explain the 6-month minimum on all service plans, automatic renewal, payments, and our $200 early cancellation fee. By booking, you agree to them.
1. Agreement and Acceptance
These Terms of Service ("Terms") form a legally binding contract between you ("Customer," "you") and Bravo Bin Cleaning LLC, a California limited liability company ("Bravo," "we," "us"). By booking a service, checking the agreement box during online booking, signing a quote, or paying for a service, you agree to be bound by these Terms.
Electronic signature
Under the California Uniform Electronic Transactions Act (Cal. Civ. Code § 1633.1 et seq.), your electronic acceptance, including checking the agreement box, has the same legal effect as a handwritten signature. We keep a record of the date and time of your acceptance.
Services
Bravo provides trash, recycling, and yard waste bin sanitization, dumpster cleaning, and residential, commercial, and HOA power washing in Fresno County, Madera County, and surrounding areas. Services are offered as one-time jobs or recurring service plans. A signed quote or booking confirmation describes your specific service and price and is part of these Terms.
Eligibility
You must be at least 18 years old and authorized to approve services at the service address.
2. Service Plans and 6-Month Minimum Commitment
ALL SERVICE PLANS (MONTHLY, BI-MONTHLY, AND QUARTERLY) REQUIRE A MINIMUM COMMITMENT OF SIX (6) CONSECUTIVE MONTHS.
By booking a service plan, you agree to receive and pay for service on your selected schedule for at least 6 months.
Your 6-month minimum term ("Minimum Term") begins on the date of your first scheduled service. Plan pricing, including any first-service discount, is offered in exchange for this commitment and is lower than one-time pricing.
During the Minimum Term, you are responsible for every scheduled service on your plan:
- Monthly plans: service every 4 weeks for 6 months
- Bi-monthly plans: service every 8 weeks for 6 months
- Quarterly plans: service every 3 months for 6 months
Skipped, paused, or missed-access visits do not extend or shorten the Minimum Term. Canceling before the Minimum Term ends results in the early cancellation fee described in Section 3.
Automatic renewal after the Minimum Term
AFTER YOUR 6-MONTH MINIMUM TERM ENDS, YOUR SERVICE PLAN RENEWS AUTOMATICALLY ON THE SAME SCHEDULE AND AT THE SAME PRICE, AND YOUR PAYMENT METHOD ON FILE WILL BE CHARGED EACH BILLING CYCLE UNTIL YOU CANCEL.
After the Minimum Term there is no further commitment and no early cancellation fee. You may cancel at any time before your next scheduled charge.
Your consent to automatic renewal
As required by California’s Automatic Renewal Law (Cal. Bus. & Prof. Code §§ 17600–17606), Bravo will not enroll you in an automatically renewing plan unless you give your affirmative consent at the time you sign up. Agreeing to these Terms alone is not consent to automatic renewal.
Before you book a service plan, the booking page will show you, clearly and next to the agreement checkbox:
- That your plan renews automatically until you cancel
- The 6-month Minimum Term and the $200 early cancellation fee
- The amount and frequency of each recurring charge
- How to cancel
You give your consent by checking the agreement box during online booking, or by signing a written quote or plan agreement that includes these automatic renewal terms. If you do not affirmatively consent to automatic renewal at signup, your plan will end at the close of your Minimum Term and will not renew unless you later agree to continue.
Confirmation and reminders
After you sign up, we will send you a confirmation by email or text that includes your plan’s automatic renewal terms, the 6-month Minimum Term, the early cancellation fee, the price, and how to cancel. Before any change to your price or renewal terms, we will notify you in advance.
How to cancel
You may cancel by phone, text, or our online contact form. If you signed up online, you may always cancel online through our contact form, without calling. We will confirm your cancellation in writing.
3. Early Cancellation Fee
IF YOU CANCEL YOUR SERVICE PLAN BEFORE THE END OF YOUR 6-MONTH MINIMUM TERM, FOR ANY REASON OTHER THAN THOSE LISTED BELOW, YOU AGREE TO PAY A $200 EARLY CANCELLATION FEE.
You authorize Bravo to charge this fee to the payment method on file on the date your cancellation takes effect.
Liquidated damages
You and Bravo agree that the damages Bravo would suffer from an early cancellation would be impracticable or extremely difficult to fix. These damages include the loss of the plan discount you received, route planning and capacity reserved for your full term, customer acquisition costs, and labor scheduled around your account.
You and Bravo agree that $200 is a reasonable estimate of those damages, made in good faith at the time of contracting, and is intended as liquidated damages under California Civil Code § 1671, not as a penalty.
When the fee does not apply
- Bravo terminates your service or materially fails to provide the service you paid for and does not correct the failure within 10 days of written notice
- You move outside our service area and provide reasonable proof of your new address
- You complete your 6-month Minimum Term
- Cancellation is otherwise required by law
How to cancel
Cancel by phone, text, or our contact form. Cancellation takes effect on the date we receive your request, and we will confirm it in writing.
4. Payment Authorization and Billing
Payment method on file
You must keep a valid credit or debit card on file through our booking system. By booking, you expressly authorize Bravo and its payment processor to charge that card for scheduled services, plan payments, the early cancellation fee when it applies, and any other amounts due under these Terms. This authorization remains in effect until all amounts owed are paid.
Failed payments and collections
If a charge is declined, we may suspend service until payment is received. Suspension does not end or extend your Minimum Term. Unpaid balances more than 30 days past due may be referred to collections, and you agree to pay reasonable collection costs to the extent permitted by California law.
Payment disputes
Please contact us before disputing a charge with your card issuer so we can resolve it directly. A chargeback filed for a fee you agreed to in these Terms does not cancel the amount owed.
Pricing
Prices are listed on our pricing page or in your quote. We may change prices for future terms with notice. Your price will not change during your Minimum Term.
5. Scheduling and Service Days
Bin cleanings are scheduled on or shortly after your waste collection day, when bins are empty. Power washing is scheduled by appointment. We will notify you of your schedule and any changes.
Weather and delays
We may reschedule because of rain, extreme heat, water restrictions, holidays, or equipment issues. A rescheduled visit is not a missed service and does not entitle you to a refund or credit.
6. Customer Responsibilities
- Leave bins at the curb or an agreed, accessible location on your service day
- Make sure bins are empty; we cannot clean bins that still contain trash
- Keep gates unlocked, pets secured, and the work area safe
- Provide access to a water source when needed for power washing
- Disclose damaged bins, loose surfaces, cracks, failing paint or sealant, and fragile areas before service
Missed access
If we arrive and cannot perform the service because bins are full, missing, or inaccessible, or the work area is blocked or unsafe, the visit counts as completed and is not refunded or credited.
Hazardous materials
We do not clean bins containing medical waste, chemicals, or other hazardous materials, and may decline or stop service if they are found.
7. Satisfaction and Damage Claims
If you are not satisfied with a service, contact us within 48 hours with photos. If the issue is our responsibility, we will re-clean at no charge.
Property damage claims must be reported in writing within 7 days of service, with photos, so we can inspect the condition. This notice period does not limit any right you have under California law that cannot be waived.
8. Disclaimer of Warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS, SERVICES ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, BRAVO DISCLAIMS ALL IMPLIED WARRANTIES. Results vary with surface age, material, and condition, and some stains or wear may not be fully removable.
9. Limitation of Liability
Bravo is not responsible for pre-existing damage, normal wear, or damage caused by city or hauler equipment. Power washing can reveal existing cracks, loose paint, failing sealant, or surface wear, and Bravo is not responsible for those conditions.
TO THE FULLEST EXTENT PERMITTED BY LAW, BRAVO IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, AND BRAVO’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM A SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THAT SERVICE.
Consistent with California Civil Code § 1668, nothing in these Terms limits Bravo’s liability for fraud, willful injury, gross negligence, or violation of law, or waives any right you have under the California Consumers Legal Remedies Act or other law that cannot be waived.
10. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Bravo, its owner, and employees from claims arising from hazardous materials placed in bins, undisclosed property conditions, or your breach of these Terms. This does not apply to claims caused by Bravo’s own negligence or misconduct.
11. Website Use
You may use bravobincleaning.com only for lawful purposes. Website content, logos, and photos are owned by Bravo and protected by law, and may not be copied without written permission. We do not guarantee the website will always be available or error-free.
12. Privacy
How we collect and use your information is described in our Privacy Policy, which is incorporated into these Terms.
13. Governing Law, Venue, and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules.
Informal resolution
Before filing any claim, each party agrees to give the other written notice describing the dispute and to try in good faith to resolve it within 30 days.
Venue
To the extent permitted by law, including California Code of Civil Procedure § 395, any lawsuit will be filed in the Superior Court of California, County of Fresno. Either party may bring a qualifying claim in small claims court.
Attorney’s fees
In any action to enforce these Terms, the prevailing party is entitled to recover reasonable attorney’s fees and costs. Under California Civil Code § 1717, this right applies equally to you and to Bravo.
14. General Provisions
- Entire agreement. These Terms, together with your quote or booking confirmation and our Privacy Policy, are the entire agreement between you and Bravo about the services.
- Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions stay in full effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, such as severe weather, natural disasters, government orders, or utility outages.
- Assignment. You may not transfer your plan without our written consent. Bravo may assign these Terms to a successor business.
- Independent contractor. Bravo performs services as an independent contractor.
- Survival. Payment obligations, the early cancellation fee, limitation of liability, indemnification, and dispute terms survive the end of your service.
- Changes. We may update these Terms. Changes apply to bookings made after the update is posted. Your current plan remains governed by the Terms you accepted.
